1. Acceptance of Terms

By accessing or using EnoDesk ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

EnoDesk provides an AI-powered virtual receptionist service that answers phone calls on behalf of your business. The Service includes:

  • AI voice receptionist for incoming calls
  • Call recording and transcription
  • Business information management
  • Phone number provisioning
  • Dashboard and analytics

2.1 AI Disclosure

EnoDesk uses artificial intelligence to power its virtual receptionist. All callers interacting with the Service will be informed they are speaking with an AI assistant, not a human.

2.2 Service Limitations - No Professional Advice

EnoDesk is designed for general business inquiry handling only. The Service is NOT intended to provide:

  • Medical or health advice — including diagnosis, treatment recommendations, or mental health services
  • Legal advice — including legal interpretations, guidance, or representation
  • Financial advice — including investment recommendations, lending decisions, or tax guidance
  • Emergency services — callers with emergencies should contact 911 or appropriate emergency services

If you operate in healthcare, legal, financial, or other regulated industries, you acknowledge that EnoDesk is limited to general inquiry handling (e.g., scheduling, business hours, service information) and must not be used to provide tailored professional advice without a qualified professional reviewing all outputs before they are communicated to callers.

3. Account Registration

To use the Service, you must create an account and provide accurate information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

4. Acceptable Use

You agree NOT to use the Service to:

  • Violate any laws or regulations
  • Engage in fraudulent, deceptive, or misleading activities
  • Harass, abuse, or harm others
  • Send spam or unsolicited communications
  • Impersonate any person or entity
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to our systems
  • Use the Service for illegal telemarketing or robocalling

5. Subscription and Payment

5.1 Pricing

Subscription fees are based on your selected plan. Prices are subject to change with 30 days notice.

5.2 Billing

Subscriptions are billed monthly or annually in advance. Payments are processed securely via Stripe.

5.3 Free Trial

Eligible plans include a free trial period. You will be charged at the end of the trial unless you cancel.

5.4 Refunds

Refunds are provided at our discretion. Contact support within 14 days of payment for refund requests.

6. Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • Service continues until the end of your billing period
  • No refunds for partial months
  • Your data will be retained for 30 days, then deleted

7. Intellectual Property

The Service, including all content, features, and functionality, is owned by EnoDesk and protected by intellectual property laws. You retain ownership of your business data and content.

8. Call Recording Consent

By using the Service, you acknowledge that calls may be recorded. You are responsible for:

  • Complying with applicable call recording laws in your jurisdiction
  • Informing callers that calls may be recorded (our AI provides this disclosure)
  • Obtaining any required consent from callers

9. SMS/Text Message Consent & Terms

EnoDesk (operated by EnoDesk LLC) provides SMS messaging services for business communications. By using EnoDesk, you acknowledge the following SMS terms.

9.1 Business Owner/Staff Notifications

By providing your mobile phone number and enabling SMS notifications during signup, you expressly consent to receive text messages including:

  • Call summary notifications after your AI receptionist handles a call
  • Missed call alerts
  • Daily activity summaries
  • Account security and verification codes
  • Service status updates

9.2 Customer Appointment Notifications (Pro Plans & Above)

If you subscribe to a Pro plan or higher, you may send transactional SMS notifications to your customers regarding appointments booked through EnoDesk. These include:

  • Appointment confirmations
  • Appointment reminders (24 hours and 1 hour before scheduled time)
  • Appointment changes or cancellations
  • Follow-up messages after service completion

Your responsibility: You are responsible for obtaining proper consent from your customers before sending appointment notifications. Consent should be collected during the booking process. Messages will identify your business name, not EnoDesk.

9.3 Message Frequency

Business owners/staff: Message frequency varies based on call volume (typically 0-20 messages per day).

Customers: Typically 1-3 messages per appointment (confirmation, reminder, follow-up).

9.4 Opt-Out

You or your customers can opt out of SMS messages at any time by:

  • Replying STOP to any message
  • Updating preferences in Settings → Notifications (business owners)
  • Contacting support at support@eno-ai.com

After opting out, a confirmation message will be sent. Opt back in by replying START or re-enabling notifications in settings.

9.5 Help

For help, reply HELP to any message or contact support@eno-ai.com.

9.6 Costs

Message and data rates may apply. Check with your mobile carrier for details.

9.7 Privacy

Mobile phone numbers and opt-in information will not be shared, sold, or provided to third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details.

10. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for any downtime or service interruptions.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENODESK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

13. Indemnification

You agree to indemnify and hold harmless EnoDesk from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

16. Dispute Resolution

Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. You waive any right to participate in class action lawsuits.

17. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.
