Welcome to EnoDesk. By accessing or using our website at eno-ai.com, our mobile applications, and our AI receptionist service (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

1. Acceptance of Terms

By creating an account or using the Service, you represent that you are at least 18 years old and have the legal authority to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Service Description

EnoDesk provides an AI-powered phone receptionist service for businesses. The Service includes automated call answering, appointment booking, call transcription, AI summaries, contact management, analytics, and related features as described on our website. The EnoDesk mobile application is provided as a companion to the web platform, allowing you to manage your account, review calls, and configure your AI receptionist on the go. Account creation and subscription management are available on the web at eno-ai.com.

AI Disclosure

The Service uses artificial intelligence to answer phone calls and interact with callers. While our AI is designed to be helpful and accurate, it may occasionally make errors or misunderstand callers. You are responsible for reviewing call summaries and taking appropriate action. EnoDesk is not liable for actions taken or not taken based on AI-generated content.

Service Limitations

The AI receptionist is designed for routine business calls — appointment booking, FAQ answering, message taking, and call routing. It is not a substitute for professional advice (legal, medical, financial) and should not be relied upon for emergency services. If your business handles emergencies, you are responsible for configuring appropriate call routing rules.

3. Account Registration

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately at support@eno-ai.com if you suspect unauthorized access.

4. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or to violate any laws
  • Transmit spam, harassment, or harmful content through the Service
  • Attempt to reverse-engineer, decompile, or disassemble the Service
  • Use the Service to impersonate any person or entity
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Service to make automated robocalls or for telemarketing
  • Resell or redistribute the Service without written permission

5. Subscription and Payment

The Service is offered on a subscription basis. Pricing, features, and plan details are described on our pricing page. By subscribing, you authorize us to charge your payment method on a recurring basis according to your chosen billing cycle (monthly or annual).

We may change our pricing with 30 days’ notice. Price changes apply at your next billing cycle. All fees are non-refundable except as required by law or as expressly stated in these Terms.

6. Free Trial

We may offer a free trial period. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial expires. You will not be charged during the trial period.

7. Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until then. We do not provide prorated refunds for partial billing periods.

8. Intellectual Property

The Service, including its software, design, text, graphics, and AI models, is owned by EnoDesk and protected by intellectual property laws. You retain ownership of your business data, call recordings, and content you upload. By using the Service, you grant us a limited license to process your data as needed to provide the Service.

9. Call Recording Consent

By using the Service, you acknowledge that calls handled by EnoDesk may be recorded and transcribed. You are responsible for complying with all applicable call recording laws in your jurisdiction, including obtaining any required consent from callers. Many jurisdictions require one-party or two-party consent for call recording. We recommend configuring your AI greeting to disclose that calls may be recorded.

10. SMS / Text Message Consent

The Service may send text messages to your callers (appointment confirmations, follow-ups) and to you (call alerts, missed-call notifications). By using the Service, you consent to receiving these messages and represent that you have the authority to send messages to your callers on your behalf. Standard messaging rates may apply. You can manage SMS settings in your account.

11. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We will make reasonable efforts to provide advance notice of planned maintenance. We are not liable for any loss or damage resulting from service interruptions.

12. Limitation of Liability

To the maximum extent permitted by law, EnoDesk and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or that AI responses will be accurate in all cases.

14. Indemnification

You agree to indemnify and hold harmless EnoDesk from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

15. Termination

We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Nevada, United States, without regard to its conflict of law principles.

17. Dispute Resolution

Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Clark County, Nevada. You agree to waive any right to a jury trial or to participate in a class action.

18. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice on our website at least 30 days before they take effect. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
